Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of DWMTrak, a candidate tracking and recruitment management system ("the Service") operated by YOUR DWM LIMITED ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Definitions
  • "User" means any individual who accesses or uses the Service, including employees, contractors, and authorised personnel of YOUR DWM LIMITED.
  • "Candidate" means any individual whose information is stored within the Service for recruitment purposes.
  • "Candidate Portal" means the self-service area where candidates can view their application status and upload documents.
3. Account Registration and Security

To use the Service, you must be provided with login credentials by an administrator. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use of your account
  • Enabling Multi-Factor Authentication (MFA) when required by your administrator
4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations, including data protection laws
  • Access or attempt to access accounts or data belonging to other users
  • Upload malicious software, viruses, or harmful code
  • Attempt to circumvent security measures or access controls
  • Use the Service to discriminate against candidates on any unlawful basis
  • Share your login credentials with unauthorised individuals
  • Export or download candidate data except as authorised for legitimate business purposes
5. Data Protection

The Service processes personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Users who process candidate data through the Service must do so in compliance with all applicable data protection laws and internal data handling policies.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by YOUR DWM LIMITED and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. Candidate Portal Terms

Candidates accessing the Candidate Portal via magic link authentication agree to:

  • Provide accurate and truthful information
  • Upload only documents they are legally entitled to share
  • Not share their magic link with others
  • Use the portal only for its intended purpose of managing their job application
8. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or security reasons without prior notice.

9. Limitation of Liability

To the fullest extent permitted by law, YOUR DWM LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless YOUR DWM LIMITED and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of the Service.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page with a new "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
